DESCRIPTION: Join the ACS Delaware Lawyer and Student chapters for a seminar, Politically Balancing the Scales of Justice. Delaware's Constitution requires that state-wide courts be balanced between the main political parties and also requires that the three primary courts must essentially be balanced between Democrats and Republicans. These requirements effectively require an applicant to those primary courts to be a Democrat or Republican. In Adams v. Carney, this requirement was recently challenged as a violation of the 1st Amendment's protections for freedom of association. The seminar will explore the constitutional ramifications of Delaware's judicial selection process.
