DESCRIPTION: Fifty years after Congress approved the ERA, 38 states (the Constitutional requirement) have voted to ratify it. So why isn't the ERA the 28th Amendment? The Congressionally-imposed seven-year time limit for passing the ERA may have lapsed, but a resolution to lift that time limit has been approved by the House and is pending before the Senate. Litigation continues in federal court as activists and state Attorneys General seek to compel the Archivist of the United States to formally publish the ERA. Meanwhile, six states have voted to rescind their ratifications, yet the legal effect of these rescissions is uncertain.
