DESCRIPTION: Please join the ACS Minneapolis-St. Paul, New York, Washington DC, Puget Sound, San Diego, Bay Area, At-Large Lawyer Chapters, and Minnesota State Bar Association Environment, Natural Resources and Energy Law Section for a conversation on environmental regulation. The decade-long battle over EPA's authority to regulate carbon pollution from power plants will finally be heard by the Supreme Court on February 28, 2022. West Virginia v. EPA could be decided on narrow grounds, such as whether the EPA properly repealed the Obama Administration's Clean Power Plan, or it could have significant implications for the power of the Clean Air Act to stem climate-change causing emissions from the largest sources in the country, or even impact the ability of agencies to issue rules interpreting and carrying out their statutory duties. Unvaccinated attendees will be required to wear masks and we will abide by all state and local health and safety protocols.\n\nJoin the Minneapolis-St. Paul Chapter of the American Constitution Society for a discussion of these important issues. The discussion will be moderated by Kathryn Hoffman, the CEO of the Minnesota Center for Environmental Advocacy, which is a party in the case. She will be joined by four environmental and administrative law attorneys who have been integral to the development of this case since its inception, and will read the tea leaves following the argument on February 28.\n\nPanelists: \n\nJay Duffy, Attorney, Clean Air Task Force\nDavid Doniger, Senior Strategic Director in the Climate & Clean Energy Program, Natural Resources Defense Council\nJody Freeman, Archibald Cox Professor of Law and Director of the Energy and Environmental Law Program, Harvard Law School\nSteven Wu, Deputy Solicitor General, Office of the New York State Attorney General\n\nModerator: \n\nKathryn Hoffman, CEO, Minnesota Center for Environmental Advocacy\n \nCLE credit: 1.0 standard hours\nAs the nation's leading progressive legal organization, ACS is committed to ensuring that all aspects of our events are accessible and enjoyable for all.
