Of the series of decisions from the Supreme Court last term that overturned long-settled precedent to imprint the conservative Justices' political views on the country, the implications of its holding in Cedar Point Nursery v. Hassid bear particular discussion. Radically expanding the idea of property rights to strike down California's farmworker organizing access law, the case has given conservative groups another tool through which to achieve their goals, and they are already deciding how to leverage their victory into future anti-regulatory policymaking through the courts.

But what specifically did the Court hold in Cedar Point Nursery? And, how can state and local governments respond to a Court that seeks to prohibit them from exercising their basic regulatory functions?
